No charges laid over 'disturbing' video incident at Patrick Fogarty

Orillia OPP say they have concluded their investigation and no criminal charges will be laid but could not say 'how the school or school board will deal with this individual'

The Orillia OPP has concluded its investigation into a “disturbing” video that was widely shared at Patrick Fogarty Catholic Secondary School earlier this month and determined “no Criminal Code violations were committed.”

Both the Orillia OPP and the Simcoe Muskoka Catholic District School Board investigated the video, which appears to show a man watching pornography in a staff room at the Orillia high school late in the evening after regular school hours.

The video was widely AirDropped onto student and staff devices, school officials said at the time.

OPP officials said the investigation now rests with the school board.

“The investigation is concluded, (and) it has been determined that no Criminal Code violations were committed,” Orillia OPP Cst. Derek Tilley told OrilliaMatters in a statement.

“The individual is known by both the OPP and the school, and the OPP will not be releasing the person’s name. The OPP cannot determine how the school or school board will deal with this individual," said Tilley, adding the local detachment has closed its investigation.

Earlier this month, Scot Gorecki, superintendent of student achievement and learning at the Simcoe Muskoka Catholic District School Board, said a board-level investigation, including the involvement of third-party authorities, was taking place.

“The safety of our students is of utmost importance, and we are committed to getting the answers that we need in order to respond appropriately,” he said. “We follow due process and apply the appropriate consequences, which will reflect the seriousness of the matter.”

The school board did not respond to requests for comment in time for publication of this story.
