Transport truck driver, company charged after Hwy. 11 complaint

The rig has been pulled off the road until repairs are done, says police, noting both the driver and the company are facing multiple charges

Another Highway 11 transport truck driver has been charged, and the rig has been pulled off the road until repairs are done, says police. 

On Jan. 27 around 10:15 a.m., someone called OPP to complain about a commercial motor vehicle (CMV) on Highway 11 in Temagami. 

When officers found the CMV, a commercial vehicle safety alliance inspection was done, said Temagami OPP in a news release. 

A 39-year-old driver from Brampton is charged with: 

  • Drive CMV with major defect in it or drawn vehicle (HTA)
  • Fail to enter defect in daily inspection report (HTA)
  • Fail to accurately complete daily inspection report (HTA)
  • Defective odometer CMV (HTA)  
  • Fail to comply with certificate conditions (TSSEA)

The Brampton company is charged with: 

  • Fail to ensure daily inspection is conducted properly (HTA)
  • Fail to ensure daily inspection report is accurately completed (HTA)
  • Fail to ensure performance standards are met (HTA)
  • Defective odometer - CMV (HTA)
  • Fail to comply with certificate conditions (TSSEA)

Police say the CMV is out of service until the required repairs are completed. 

This is the second recent report of an unsafe CMV being pulled off Highway 11.

On Sunday near Opasatika, someone called the police about a CMV with a wobbling rear wheel. An inspection of that vehicle reveal severe blackening and misalignment of the rear of the trailer, and that one of the wheels only had half of its lug nuts attached.
